In this Privacy Policy, "Footfall", "we", "us", and "our" refer to Purple Media LLC in connection with the Footfall service.

1. Scope of This Privacy Policy

This Privacy Policy applies to personal information processed through Footfall, including when you:

  • visit the Footfall website;

  • create or use a Footfall account;

  • browse brands or events;

  • follow a brand;

  • register for an event;

  • join a waiting list;

  • purchase or obtain tickets or registrations;

  • check in to an event;

  • complete forms, surveys, feedback forms, or questionnaires;

  • upload information or files;

  • receive event notifications or reminders;

  • share an event with another person;

  • communicate with an event organizer;

  • communicate with Footfall;

  • receive marketing or brand communications where permitted; or

  • otherwise interact with Footfall.

This policy also applies where another person provides your information through Footfall, such as when someone shares an event with your email address.

Individual event organizers or brands may have their own privacy policies. Their handling of personal information outside Footfall is governed by their own privacy practices.

2. Who Is Responsible for Your Information?

Depending on the circumstances, Purple Media LLC and an event organizer or brand may have different legal roles in relation to your personal information.

Footfall acting for its own purposes

Purple Media LLC generally determines how and why personal information is processed for purposes such as:

  • operating Footfall;

  • maintaining user accounts;

  • platform security;

  • fraud and abuse prevention;

  • service communications;

  • platform analytics and improvement;

  • legal compliance;

  • managing communication preferences; and

  • providing customer support.

For these activities, Purple Media LLC generally acts as a controller, business, or organization responsible for the information, depending on the terminology used by applicable law.

Information processed for event organizers

An event organizer may determine what information attendees are required to provide, why it is collected, who may attend an event, and how attendee information is subsequently used.

Where Footfall processes information solely on an organizer's instructions in order to provide event management services, the organizer may be the controller or equivalent responsible organization and Purple Media LLC may act as its processor or service provider.

In other circumstances, Purple Media LLC and the organizer may each independently be responsible for particular processing activities.

Questions about an organizer's independent use of your information should generally be directed to that organizer.

3. Personal Information We Collect

The personal information we collect depends on how you use Footfall.

Account information

This may include:

  • name;

  • email address;

  • telephone number;

  • account identifiers;

  • login and authentication information;

  • profile information;

  • communication preferences;

  • brands you follow; and

  • account settings.

Event registration information

Depending on the event, this may include:

  • name;

  • email address;

  • telephone number;

  • organization or employer;

  • job title;

  • registration type;

  • ticket or registration information;

  • attendance status;

  • waiting-list status;

  • guest information;

  • answers to registration questions;

  • dietary or accessibility requests;

  • preferences;

  • check-in information;

  • feedback; and

  • other information requested by the event organizer.

Organizers should only request information that is reasonably necessary for the event.

Information you submit

We may process information that you provide through:

  • registration forms;

  • event forms;

  • surveys;

  • feedback forms;

  • uploaded files;

  • customer support requests;

  • messages;

  • photographs or other media where the applicable Footfall feature permits them; and

  • other user-submitted content.

Event-sharing information

If you use Footfall to share an event with another person, we may process:

  • the recipient's email address;

  • information identifying the event;

  • information identifying the sender where applicable;

  • delivery information;

  • suppression or objection information;

  • abuse reports; and

  • related technical records.

If another person shares an event with you, we may receive your email address from that person.

Transaction information

Where an event involves payment, we may process information concerning:

  • the transaction;

  • amount;

  • currency;

  • payment status;

  • transaction identifiers;

  • refunds; and

  • associated registration information.

Payment card or banking information may be processed directly by a third-party payment provider rather than stored by Footfall. Where that occurs, the payment provider's privacy terms also apply.

Device and technical information

When you use Footfall, we may automatically receive information such as:

  • IP address;

  • browser type;

  • device type;

  • operating system;

  • approximate location derived from an IP address;

  • language;

  • referring pages;

  • pages or features accessed;

  • timestamps;

  • session information;

  • error and diagnostic information; and

  • security and authentication records.

Cookies and similar technologies

Footfall may use cookies, local storage, pixels, or similar technologies for purposes including:

  • authentication;

  • remembering preferences;

  • security;

  • preventing fraud and abuse;

  • maintaining sessions;

  • measuring service performance;

  • analytics; and

  • where permitted and enabled, advertising or campaign measurement.

Where applicable law requires consent before non-essential cookies or similar technologies are used, we will request that consent before activating those technologies.

4. Where We Obtain Personal Information

We may obtain personal information:

  • directly from you;

  • from another Footfall user;

  • from an event organizer or brand;

  • through your interactions with Footfall;

  • automatically from your browser or device;

  • from payment, authentication, email, messaging, hosting, analytics, or other service providers;

  • from an organization registering attendees for an event; or

  • from other sources where permitted by law.

Where someone shares an event with you, we generally obtain your email address from the person who initiated the share.

5. How We Use Personal Information

We may use personal information to:

Provide Footfall

This includes:

  • creating and managing accounts;

  • displaying events;

  • processing event registrations;

  • managing capacity and waiting lists;

  • providing tickets, confirmations, or registration records;

  • supporting event check-in;

  • delivering reminders and event updates;

  • administering forms and feedback;

  • processing transactions;

  • enabling users to share events; and

  • providing requested features.

Communicate with you

We may use your information to:

  • send registration confirmations;

  • send event reminders;

  • notify you of changes to events;

  • respond to support requests;

  • provide security or account notifications;

  • send information relating to services you use; and

  • provide optional marketing or brand updates where permitted.

Personalize the service

We may use account settings, followed brands, registrations, and preferences to display information relevant to your use of Footfall.

Maintain security and prevent abuse

We may process information to:

  • authenticate users;

  • detect suspicious activity;

  • prevent spam;

  • prevent fraudulent registrations;

  • enforce sending and usage limits;

  • investigate abuse reports;

  • maintain suppression lists;

  • protect accounts;

  • secure the platform; and

  • enforce our terms.

Operate and improve Footfall

We may analyze service usage to:

  • diagnose technical problems;

  • measure performance;

  • understand how features are used;

  • improve usability;

  • develop new features; and

  • maintain the reliability of the service.

Where reasonably possible, we may use aggregated or de-identified information for these purposes.

Comply with law and protect legal rights

We may process or disclose information where reasonably necessary to:

  • comply with legal obligations;

  • respond to lawful requests;

  • establish, exercise, or defend legal claims;

  • enforce agreements;

  • investigate suspected illegal activity; or

  • protect the rights, safety, or property of Purple Media LLC, our users, event organizers, or others.

6. Legal Bases for Processing in the EEA and UK

Where the EU GDPR or UK GDPR applies, we rely on one or more of the following legal bases.

Performance of a contract

We may process personal information where necessary to provide Footfall services that you request, including maintaining your account and processing your registrations.

Legitimate interests

We may process information where necessary for legitimate interests pursued by Purple Media LLC or another party, provided those interests are not overridden by your rights and interests.

These interests may include:

  • operating and improving Footfall;

  • securing the service;

  • preventing fraud and abuse;

  • understanding service performance;

  • providing customer support;

  • maintaining records;

  • protecting legal rights; and

  • facilitating event administration.

Consent

We rely on consent where required, including for certain:

  • marketing communications;

  • optional cookies or tracking technologies;

  • collection or use of particular categories of information; or

  • other processing for which consent is the appropriate legal basis.

You may withdraw consent at any time. Withdrawal does not affect processing that was lawful before withdrawal.

Legal obligation

We may process information where necessary to comply with applicable law.

Other lawful bases

Where permitted by applicable law, processing may also occur where necessary to protect vital interests or perform another legally recognized task.

7. Sensitive and Special Category Information

Certain event organizers may request information that could be considered sensitive or special category personal information, such as dietary requirements that reveal health or religious information, accessibility needs, or similar information.

Footfall does not require event organizers to collect such information unless it is relevant to the event.

Where sensitive information is collected, it must be processed only where an appropriate legal basis exists and with additional protections where required by law.

Event organizers are responsible for ensuring that any sensitive information they choose to request is lawful, necessary, and proportionate.

Please avoid submitting unnecessary sensitive personal information.

8. Event Organizers and Brands

When you register for or interact with an event, relevant registration information may be made available to the organizer of that event.

The organizer may use the information to:

  • administer registrations;

  • verify eligibility;

  • manage attendance;

  • communicate event information;

  • provide event services;

  • respond to attendee requests; and

  • fulfill other purposes disclosed when the information is collected.

An organizer must not use attendee information for unrelated marketing or other incompatible purposes unless it has an independent lawful basis for doing so.

Once an organizer obtains information from Footfall and independently determines how that information will be used, its own privacy practices and legal obligations may apply.

9. Brand Following and Marketing

If you choose to follow a brand or opt in to permitted brand communications, Footfall may use your information to provide relevant brand or event updates.

You can manage available communication preferences through Footfall or use the unsubscribe or preference controls included in applicable messages.

Withdrawing from optional marketing does not prevent us or an organizer from sending communications reasonably necessary to administer an event for which you are registered.

We do not treat registration for an event as consent to receive unrelated marketing unless applicable law permits the communication on another basis.

10. Sharing Events With Other People

Footfall allows users to share event information with other people.

The person initiating a share is responsible for ensuring that they are legally permitted to provide the recipient's email address and initiate the communication.

When a recipient email address is entered, Footfall may use it to:

  • deliver the requested event information;

  • manage email delivery;

  • protect the sharing system from abuse;

  • process objections;

  • maintain suppression records; and

  • investigate complaints.

Receiving a shared event does not create a Footfall account and does not, by itself, enroll the recipient in Footfall marketing.

Every event-sharing email includes a link to stop future event-sharing invitations to that address or report the message. Reporting also opts the address out, and sends an alert to the Footfall team. We retain a keyed, non-reversible identifier for an opted-out address, together with the opt-out date, for as long as needed to honor the request and prevent further invitations. Reports also record the report date and event so we can review and address misuse.

Each preference link uses a random token, expires after two years, and is removed during a later expired-token cleanup. For new event-sharing emails, Footfall application logs do not store the recipient address; our email delivery provider necessarily processes the address to deliver the message. Older delivery logs are not rewritten by this change.

We may retain limited suppression information after an objection where necessary to ensure that the request is respected.

11. Service Communications

We may send communications that are reasonably necessary in connection with:

  • your account;

  • event registrations;

  • waiting-list status;

  • payments;

  • tickets;

  • event changes;

  • security;

  • privacy;

  • support requests; or

  • operation of services you have requested.

These are different from optional marketing communications.

12. When We Share Personal Information

We may disclose personal information to the following categories of recipients where reasonably necessary.

Event organizers and brands

Information may be provided to the organizer responsible for an event you register for or otherwise interact with.

Service providers

We may use providers that support functions such as:

  • cloud infrastructure and hosting;

  • databases;

  • email delivery;

  • SMS or messaging;

  • authentication;

  • payment processing;

  • analytics;

  • security;

  • customer support;

  • error monitoring; and

  • other technical services.

These providers may process information on our behalf subject to appropriate contractual and security requirements.

Professional advisers

Information may be provided where necessary to lawyers, accountants, auditors, insurers, or other professional advisers.

Legal and regulatory authorities

We may disclose information where required by law or where reasonably necessary to protect legal rights, safety, or security.

Corporate transactions

If Purple Media LLC or Footfall is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar transaction, personal information may be disclosed as part of that transaction subject to appropriate protections.

13. Sale and Sharing of Personal Information

Purple Media LLC does not sell personal information for monetary payment as part of Footfall's ordinary event-management service.

If Footfall uses advertising, analytics, or similar technologies in a manner that is legally considered a "sale", "sharing", targeted advertising, or cross-context behavioral advertising under an applicable privacy law, we will provide any notice, consent mechanism, opt-out mechanism, or browser-based preference recognition required by that law.

Where legally required, users will be able to exercise applicable opt-out rights through Footfall's privacy controls.

We do not knowingly sell or share personal information of children in circumstances prohibited by applicable law.

14. International Transfers

Purple Media LLC is located in the United States and Footfall may use service providers located in the United States or other countries.

As a result, personal information may be processed outside the country where you live.

Where the GDPR, UK GDPR, or another law restricts international transfers of personal data, we use an appropriate lawful transfer mechanism where required. Depending on the circumstances, this may include:

  • an adequacy decision;

  • approved standard contractual clauses;

  • an applicable data privacy framework;

  • contractual safeguards; or

  • another legally permitted transfer mechanism.

15. How Long We Keep Personal Information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including satisfying legal, contractual, accounting, security, dispute-resolution, and enforcement requirements.

Retention may vary depending on the information and context.

For example:

  • account information may be retained while an account remains active and for a reasonable period afterward;

  • registration information may be retained for the period necessary to administer an event and maintain appropriate records;

  • transaction records may be retained as required for accounting, tax, fraud-prevention, and legal purposes;

  • security records may be retained for a period appropriate to detecting and investigating misuse;

  • support records may be retained for reasonable service and legal purposes;

  • marketing preferences may be retained while relevant to the communication relationship; and

  • suppression records may be retained as necessary to ensure that an unsubscribe, objection, or block request continues to be respected.

We may retain anonymized or de-identified information where it can no longer reasonably be associated with an identifiable individual.

Where Footfall processes personal information solely on behalf of an event organizer, retention may also be determined by the organizer's instructions and applicable law.

16. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include access controls, authentication measures, encryption where appropriate, logging, monitoring, backups, vendor controls, and security procedures.

No internet-based service can guarantee absolute security.

If you believe your Footfall account or personal information may have been compromised, contact admin@footfall.events.

17. Your Privacy Rights

Your rights depend on where you live and which law applies.

Subject to applicable exceptions and verification requirements, you may have the right to:

  • know whether we process your personal information;

  • request access to personal information;

  • obtain a copy of personal information;

  • correct inaccurate or incomplete information;

  • request deletion;

  • request restriction or cessation of certain processing;

  • object to certain processing;

  • withdraw consent;

  • request portability of information;

  • opt out of certain marketing;

  • opt out of sale, sharing, or targeted advertising where applicable;

  • limit certain uses of sensitive personal information;

  • object to decisions based solely on certain automated processing;

  • complain to an applicable regulator; and

  • exercise your rights without unlawful discrimination or retaliation.

Not every right applies in every jurisdiction or circumstance.

18. EEA and UK Privacy Rights

Where the EU GDPR or UK GDPR applies, you may have rights including:

  • access;

  • rectification;

  • erasure;

  • restriction of processing;

  • data portability;

  • objection to processing;

  • withdrawal of consent; and

  • rights relating to certain automated decision-making.

Right to object to direct marketing

You have the right to object at any time to the use of your personal data for direct marketing. If you object, we will stop using your personal data for that direct marketing.

Where processing is based on legitimate interests, you may also object based on your particular situation, subject to applicable legal exceptions.

You may lodge a complaint with the data protection authority in the country where you live or work or where you believe a violation occurred.

UK users may complain to the UK Information Commissioner's Office.

EEA users may complain to the competent supervisory authority in their relevant EEA jurisdiction.

19. Canada

Where Canadian privacy law applies, you may request information about the existence, use, and disclosure of your personal information and request access to that information, subject to applicable exceptions.

You may also challenge the accuracy and completeness of your information and request appropriate correction.

Where processing depends on your consent, you may withdraw consent subject to reasonable notice and applicable legal or contractual restrictions.

  • request cessation of collection, processing, or use; and

  • request deletion,

This section applies to the extent that the California Consumer Privacy Act, as amended, applies to Purple Media LLC's processing of your personal information.

California residents may have rights including the right to:

  • know the categories and specific pieces of personal information collected;

  • know the sources from which personal information was collected;

  • know the purposes for collecting, using, selling, or sharing personal information;

  • know the categories of third parties to whom information is disclosed;

  • request deletion;

  • request correction;

  • opt out of sale or sharing of personal information;

  • limit certain uses or disclosures of sensitive personal information; and

  • exercise privacy rights without unlawful discrimination.

Where California law requires an opt-out mechanism for sale or sharing, Footfall will provide an appropriate Your Privacy Choices, Do Not Sell or Share My Personal Information, or equivalent control and will recognize legally required preference signals, including applicable browser-based opt-out signals.

Residents of certain U.S. states may have additional rights relating to:

  • access;

  • correction;

  • deletion;

  • portability;

  • targeted advertising;

  • sale of personal information;

  • profiling; or

We may take reasonable steps to verify your identity before fulfilling certain requests.

Where permitted by law, an authorized agent may make a request on your behalf. We may require evidence of the agent's authority and may take reasonable steps to verify the request.

We will respond within the period required by applicable law.

We will not unlawfully discriminate against you for exercising a privacy right.

24. Marketing Choices

You can unsubscribe from optional email marketing through the unsubscribe or preference controls contained in applicable communications.

Where Footfall provides account-level communication preferences, you may also manage permitted communications through your account.

An unsubscribe from marketing does not necessarily stop transactional or service communications relating to registrations, accounts, security, or services you have requested.

25. Cookies and Tracking Choices

Where available, you may use Footfall's cookie controls to enable or disable categories of non-essential cookies.

You may also be able to control cookies through your browser or device.

Blocking certain necessary technologies may prevent parts of Footfall from operating correctly.

Where applicable law requires us to recognize a legally valid universal opt-out mechanism or browser preference signal, we will do so.

26. Automated Decision-Making

Footfall may use automated processes for ordinary platform functions such as:

  • capacity management;

  • waiting-list administration;

  • spam detection;

  • fraud detection;

  • security monitoring; and

  • abuse prevention.

We do not intend to make solely automated decisions about individuals that produce legal or similarly significant effects unless appropriate notice, safeguards, and rights are provided where required by law.

27. Children's Privacy

Footfall is not intended to enable children to create accounts or provide personal information where doing so would violate applicable law.

Events may be family-friendly or permit attendance by children. Where an organizer collects information directly about a child, the organizer must ensure that it has an appropriate legal basis and obtains parental or guardian consent where required.

If we become aware that personal information about a child has been collected in circumstances that do not comply with applicable law, we may delete or restrict the information.

A parent or guardian who believes that Footfall holds personal information about a child improperly may contact admin@footfall.events.

28. Third-Party Websites and Services

Footfall may contain links to websites, social networks, payment services, maps, video services, event organizers, or other third-party services.

Their privacy practices are governed by their own policies. This Privacy Policy does not control independent third-party services.

29. Data Breaches

We maintain procedures designed to identify and respond to security incidents involving personal information.

Where applicable law requires notification of a personal data breach to affected individuals, regulators, event organizers, or other parties, we will provide the required notification within the applicable timeframe.

30. Changes to This Privacy Policy

We may update this Privacy Policy to reflect:

  • changes to Footfall;

  • changes to our processing activities;

  • new features;

  • changes in service providers;

  • changes in applicable law; or

  • improvements to our privacy practices.

The current version will be published through Footfall with its effective date.

Where required by law, we will provide additional notice or obtain consent before materially changing how existing personal information is used.
